The Brazilian Senate has withdrawn article Nº 4 of the Provisional Measure 959/2020, which postponed the enforcement of Brazilian General Data Protection Law (LGPD), the LGPD will come into force immediately after the President sanctioning or vetoing the Conversion Bill, that is, no later than 15 days after its receivement by the President.

The administrative sanctions for non-compliance will only come into force in August 2021 which, as stated by the Government, will guarantee a timely adaptation to those who are bound by the LGPD and the effective creation of the Brazilian Data Protection Authority (ANPD), whom will be responsible for overseeing, enforcing the LGPD and applying its sanctions.

In relation to the ANPD, the Decree 10.474 / 2020 was published today, which defines the regulatory structure of the authority. Thus, the beginning of the activities of the ANPD now depends on the appointment of its members.
