On Wednesday (4/29/2020), The Brazilian President Jair Bolsonaro published the Provisional Measure 595/2020 (“MP”), which, among other aspects, postpones the entry into force of the Brazilian General Data Protection Law (“LGPD”) to May 3rd, 2021.

The postponement was expected with the imminent vote of the Draft Bill No 1,179/2020 by the House of Representatives, which, unlike the MP, proposes to postpone the entry into force of the LGPD to January 2021 and only the application of penalties to August 2021. Such proposal was made based on the arguments that the LGP is essential to the country and postponing the application of sanctions would be sufficient to avoid excessive burdens on those who process personal data in a moment of economic crisis.

The MP shall be voted by the National Congress in the coming weeks for becoming a law and to not lose its effectiveness. Despite the intentions to try to reverse the postponement model proposed by the MP, the expectation is that the fractional postponement proposed by the Senate in the Draft Bill will lose strength and that a single date will be maintained for the entry into force of the law and application of sanctions in case of non-compliance with the LGPD.
